Terms of Service

Please Read Carefully: By accessing and using ViralPilot ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, subscribing to a plan, or otherwise using ViralPilot (operated at getviralpilot.com), you agree to these Terms of Service, our Privacy Policy, and all applicable laws and regulations. These terms constitute a legally binding agreement between you and ViralPilot.

By using ViralPilot, you also agree to be bound by the YouTube Terms of Service. ViralPilot uses YouTube API Services, and your use of any YouTube-related features within ViralPilot is subject to the YouTube Terms of Service.

2. Description of Service

ViralPilot is an AI-powered video generation and social media publishing platform. The Service allows you to:

  • Generate short-form videos using AI-written scripts, AI-generated images, voiceover, and animated captions
  • Animate images using AI image-to-video (I2V) technology
  • Connect social media accounts (TikTok, Instagram, YouTube) for automated publishing
  • Schedule and automatically publish videos to connected platforms
  • Manage video series, content calendars, and publishing workflows

3. Eligibility

You must be at least 13 years old (or 16 in the EU/EEA) to use the Service. By using ViralPilot, you represent that you meet this age requirement and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

4. User Accounts

To use the Service, you must:

  • Create an account using accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Not share your account with others or create multiple accounts to circumvent usage limits

You are responsible for all activities that occur under your account, including all content generated and published through the Service.

5. Social Media Authorization

When you connect social media accounts to ViralPilot, you:

  • Authorize ViralPilot to upload and publish content on your behalf to your connected platforms
  • Confirm that you own or have authorized access to the social media accounts you connect
  • Agree to comply with each platform's terms of service and community guidelines
  • Understand that you can revoke access at any time through your ViralPilot dashboard or directly on the platform
  • Accept that ViralPilot will only post content that you have explicitly authorized through series scheduling or manual publishing

For details on the specific permissions requested for each platform, see our Privacy Policy (Sections 11–13).

6. Subscriptions, Credits, and Billing

6.1 Credit-Based System

The Service operates on a credit-based system. Each subscription plan includes a monthly credit allocation. Credits are consumed when you generate videos:

  • Series videos: 100 credits per video
  • AI Director videos: 250 credits per video

Unused credits do not roll over to the next billing cycle. Your credit allocation resets at the start of each billing period.

6.2 Plans and Pricing

ViralPilot offers the following subscription tiers:

  • Hobby — 2,000 credits/month (approximately 20 series videos). Includes 1 series slot and AI-animated hook scene (first scene of each video).
  • Daily — 5,000 credits/month (approximately 50 series videos). Includes 1 series slot and AI animation on approximately 50% of scenes.
  • Pro — 10,000 credits/month (approximately 100 series videos). Includes 1 series slot and full AI animation on every scene.

Current pricing is displayed on our pricing page. We reserve the right to change pricing with 30 days' advance notice to existing subscribers. Price changes do not affect the current billing period.

6.3 Addon Series Slots

All plans include 1 series slot by default. You may purchase additional series slots as addons. Each addon slot also includes bonus credits:

  • Hobby: +1,500 bonus credits per addon slot
  • Daily: +3,000 bonus credits per addon slot
  • Pro: +5,000 bonus credits per addon slot

Addon slots are billed monthly alongside your subscription. When you cancel your subscription, addon slots are also cancelled at the end of the billing period.

6.4 Free Trial

New users may be eligible for a 3-day free trial. During the trial:

  • You receive 300 credits (enough for 3 series videos)
  • AI Director and Clone features are not available during the trial
  • A valid payment method is required to start the trial
  • You will not be charged during the trial period
  • If you do not cancel before the trial ends, your subscription will begin and you will be charged for your selected plan

The free trial is available once per user. Creating multiple accounts to obtain additional trials is a violation of these terms.

6.5 Billing

  • Subscriptions are billed on a recurring monthly basis through Stripe
  • Your subscription renews automatically unless cancelled before the renewal date
  • You authorize us to charge your payment method on file for recurring subscription fees
  • If a payment fails, you will have a 7-day grace period during which you can update your payment method and continue using the Service
  • If payment is not resolved within the grace period, your account will be suspended until payment is received

6.6 Cancellation

  • You may cancel your subscription at any time from your dashboard settings
  • Cancellation takes effect at the end of your current billing period
  • You retain full access to the Service until the end of the paid period
  • We do not offer prorated refunds for partial billing periods
  • You may reactivate your subscription before the end of the billing period if you change your mind

6.7 Refund Policy

We want you to be satisfied with the Service. The following refund policy applies:

  • Within 48 hours of your first payment: Full refund available if you have used no more than 3 video credits (300 credits)
  • Technical failures: If the Service fails to deliver videos due to errors on our end, we will issue credits or a refund at our discretion
  • No refunds: For consumed video credits, addon purchases, or cancellations after the 48-hour window

To request a refund, contact support@getviralpilot.com within the eligible period.

7. Content and Intellectual Property

7.1 Your Content

  • You retain ownership of the topics, ideas, and inputs you provide to the Service
  • You grant us a limited, non-exclusive license to process, store, and publish your content to your connected social media accounts as directed by you
  • You represent that you have all necessary rights to any content you provide as input

7.2 AI-Generated Content

  • Videos, scripts, images, and voiceovers generated by the Service are created based on your inputs using third-party AI models
  • You own the output generated for you through the Service, subject to the underlying AI provider terms
  • You are solely responsible for reviewing all generated content before publishing it
  • We do not guarantee that AI-generated content is factually accurate, original, or free from error or bias
  • AI-generated images are created using licensed models — you may use the outputs commercially

7.3 Our Intellectual Property

The ViralPilot name, brand, logo, website design, software, and proprietary technology are owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. Acceptable Use

You agree not to use the Service to:

  • Generate or publish spam, misleading, or deceptive content
  • Create content that violates any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Generate hateful, abusive, harassing, or threatening content
  • Create content that sexually exploits or endangers minors
  • Distribute malware or engage in unauthorized access to systems
  • Impersonate others or misrepresent your identity or affiliation
  • Circumvent usage limits, rate limiting, or security measures
  • Use the Service in any way that violates platform community guidelines
  • Resell, sublicense, or provide the Service to third parties without our written authorization

We reserve the right to suspend or terminate accounts that violate these rules, without refund, at our sole discretion.

9. Platform Compliance

By using the Service to publish content to social media platforms, you agree to:

  • Be bound by the YouTube Terms of Service when using YouTube-related features within ViralPilot
  • Comply with the terms of service of TikTok, Instagram, YouTube, and any other connected platform
  • Accept that platform-specific content restrictions, rate limits, and moderation policies apply to content published through the Service
  • Understand that ViralPilot is not responsible for actions taken by platforms against your accounts (including content removal, strikes, or account suspension)

10. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted or error-free operation
  • We may perform scheduled maintenance that temporarily affects access to the Service
  • Third-party service outages (AI providers, social media APIs, payment processors) may temporarily affect functionality
  • We are not liable for damages resulting from service interruptions beyond our control

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • We are not responsible for content posted to your social media accounts through the Service — you are responsible for reviewing content before publishing
  • We are not liable for actions taken by social media platforms against your accounts
  • We are not liable for AI-generated content that is inaccurate, offensive, or otherwise problematic
  • Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim

12. Indemnification

You agree to indemnify, defend, and hold harmless ViralPilot, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Service
  • Content you generate or publish through the Service
  • Your violation of these Terms
  • Your violation of any third-party rights or applicable laws

13. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

14. Third-Party Services

The Service integrates with third-party platforms and AI providers. We are not responsible for:

  • The availability, performance, or accuracy of third-party services
  • Changes to third-party APIs, pricing, or terms of service
  • Data processed by third-party services according to their own privacy policies
  • Actions taken by third-party platforms regarding your content or accounts

15. Termination

15.1 By You

You may terminate your account at any time by:

  • Cancelling your subscription in your dashboard settings
  • Requesting account deletion by contacting support@getviralpilot.com

Upon cancellation, you retain access until the end of your current billing period. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

15.2 By Us

We may suspend or terminate your account immediately, without prior notice, if you:

  • Breach these Terms of Service
  • Engage in fraudulent or illegal activity
  • Abuse the Service or other users
  • Fail to pay subscription fees after the 7-day grace period

Upon termination by us for cause, your right to use the Service ceases immediately and no refund will be provided. We may retain certain data as required by law or for legitimate business purposes as described in our Privacy Policy.

16. Dispute Resolution

16.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@getviralpilot.com to attempt to resolve the dispute informally. We will make a good-faith effort to resolve your concern within 30 days.

16.2 Arbitration

If informal resolution fails, any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration rather than in court, except for claims that qualify for small claims court. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.

16.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action, class arbitration, or any other representative proceeding.

17. Changes to These Terms

We may update these Terms of Service from time to time. When we make changes:

  • We will update the "Last Updated" date at the top of this page
  • For significant changes, we will notify you via email at least 30 days before the changes take effect
  • Continued use of the Service after the effective date constitutes acceptance of the updated terms

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought in the courts located in the United States.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ViralPilot regarding the Service and supersede all prior agreements, representations, and understandings.
